Commercial Litigation
Bleakley Bavol Denman & Grace provides aggressive representation to its clients who have been financially injured in business dealings. Whether the claim involves a complex commercial dispute between large businesses, a securities violation, unfair competition and covenants not to compete, franchising issues, breach of contract, or the simple collection of an overdue debt, the firm's attorneys will always seek to advance the client's business interests through negotiation, litigation, and, if necessary, trial.

Construction Litigation
We have significant construction litigation experience representing builders, developers, subcontractors, and suppliers on both commercial and residential construction projects. Our clients have included general contractors on both privately and publicly funded projects, as well as builders, subcontractors and suppliers in construction defect cases. These cases have included issues such as contract interpretation and the scope of work, cause and origin of alleged fire, water and mold defect and damage, the enforcement of construction liens, and the defense of claims of building design defect. Our experience is as diverse as successfully litigating a claim involving allegations of defective water valves utilized on a construction project in Dubai, to successfully defending the builder of a luxury Florida waterfront home against claims of defective design and construction alleging widespread mold damage and remediation. The complexity of the projects differs widely, and we staff each matter with the team members that will bring about the desired result while keeping in mind the overall cost to the client.

Drug and Medical Device Liability
We have over twenty-five years experience representing drug and medical device manufacturers in the defense of products liability lawsuits. We also provide our clients with advice in the area of FDA regulatory compliance. Our experience includes the successful defense of mass tort cases, including individual actions, class actions, and multi-district litigation, as national, regional, and local counsel. We have tried cases before juries throughout the United States, and have successfully defended cases through appeal to state and federal appellate courts.

Employment Practice
Bleakley Bavol Denman & Grace handles both transactional and litigated employment matters. Whether seeking to protect the interest of the company or the employee, the firm negotiates, drafts, and enforces complicated employment agreements for key employees, executives, officers, directors, or managers of large and small companies. The firm conscientiously seeks to protect its corporate clients from trade secret theft, unfair competition, and solicitation of key employees by competitors through the preparation of confidentiality agreements, noncompete and nonsolicitation agreements, and other restrictive covenants to protect a company's intellectual property rights. At the conclusion of any employment relationship, the threat of litigation may exist. The firm also handles the negotiation, drafting and enforcement of separation agreements. Finally, the firm often defends its corporate client's interests when an employee sues the company for damages under federal, state, or administrative laws arising out of the employment relationship. Whether defending claims for unlawful retaliation, discrimination, unpaid wages or overtime, the firm immediately investigates and defends the claim whether in federal or state court.

Estate Planning & Probate
Bleakley Bavol Denman & Grace understands the importance of pre- and post- mortem planning to achieve both the financial and personal goals of its clients. The firm represents individuals, families, and business owners in the areas of asset protection, wealth transfer, business succession planning, tax minimization and post-death planning. The firm assists clients with their personal estate planning, probate, and trust law needs through the preparation of wills (simple and complex), revocable living trust agreements, irrevocable trust agreements, living wills, durable powers of attorney, health care surrogate designations, preneed guardian declarations, and charitable planning. Bleakley Bavol Denman & Grace also provides guidance and assistance to personal representatives (or executors), trustees, and beneficiaries in estate and trust administration, including probate administration, summary administration, creditors' claims, estate and trust distributions, and homestead issues.

General and Premises Liability Claims
The firm has extensive jury trial experience defending premises liability (slip/trip & fall) and general liability claims brought against business owners including large retail stores, restaurant owners, property managers of large commercial properties (such as shopping malls and hotels) and businesses providing floor maintenance services to property owners. Those who "occupy" a property - like a shop owner leasing a property in a strip mall or a tenant leasing a rental property - may also face liability for visitor injury, and these companies are constant targets for the plaintiff's bar. The firm also offers risk management advice and training to clients to minimize premises and general liability exposure.

Insurance Defense
Bleakley Bavol Denman & Grace provides representation to clients in the insurance industry in the areas of automobile liability, workers' compensation, property damage, personal injury protection, premises liability, uninsured/underinsured liability, drug and medical device liability, product liability, director and corporate liability claims. The firm works closely with insurance claims professionals, as well as with the insured, to swiftly resolve any dispute in the most cost effective manner. Whether the decision of the client is to swiftly settle a disputed claim, or to aggressively defend the claim through trial, the firm works to diligently and efficiently effectuate the best interest of the client.

Product Liability
One area in which we have most highly developed our client partnering capabilities is defending products liability lawsuits. Our representation has included the defense of claims alleging defects in product design, manufacturing, and warnings relating to a wide array of manufactured products, including automotive products (e.g., safety-related products such as airbag, seatbelt and brake systems), hand power tools, consumer products, and food products. We also specialize in claims relating to medical devices, medical implants, drug delivery systems, and pharmaceuticals. This extensive experience positions us beyond our peers when it comes to the defense of both engineering/science and medical-related issues arising out of commercial products liability.

Professional Liability Defense
Our significant experience in the successful defense of medical device and drug manufacturers provides a unique insight into the defense of health care professionals in medical malpractice cases - cases that often involve the use of medical devices. Our understanding of the science and the business allows us to steer our clients around obstacles that could result in disastrous strategy decisions by the uninitiated. For example, rather than engaging in "finger-pointing" contests when physicians and device manufacturers are co-defendants, we often recommend entering into joint defense agreements to keep a unified defense position as long as possible in the litigation. This results in holding down costs and preventing inflation of case indemnity values that often result when the defendants "beat each other up" to the pleasure of the plaintiff.

Sports Law
The firm represents professional sports franchises and professional athletes in player injury cases, contract negotiations, and labor and employment disputes. In addition, the firm has represented professional sports franchises in their stadium & arena issues, contract disputes, vendor and customer disputes, insurance negotiations and disputes, trademark infringement, and all issues pertaining to the collective bargaining agreement. The firm's experience representing teams and players includes jury trials, arbitrations, and mediations.

Trademark and Copyright Litigation
The firm has significant experience in the prosecution of claims for federal and state trademark infringement, counterfeiting, false designation of origin and false description, cyber-squatting, dilution, and unfair competition as related to the sale, distribution, promotion, and advertisement of myriad consumer products. We have also successfully enforced franchise trademarks and trade names against former franchisees attempting to do business by utilizing slightly altered names, designs, and other branded items.

Trucking, Cargo, and Automobile Liability Claims
Since its inception, the firm has provided specialized representation to the trucking industry.  The firm has handled all manner of significant injury and death claims.  Firm lawyers are ready to go with immediate investigation of large loss claims.  The firm understands the importance of preserving evidence, securing its “work product” investigation and initiating the “attorney-client” relationship at the earliest stages following a large loss claim.    Firm lawyers are sometimes called to accident scenes in the middle of the night and in practically every venue of Florida in order to effectuate a timely investigation.  As a so called “target defendant”, trucking industry clients understand the importance of hiring a firm that has specialized knowledge and experience with these incidents.

The firm’s representation of its trucking industry clients also includes handling cargo claims and losses under the Carmack Amendment.  The firm also handles other serious as well as garden variety auto negligence claims for insurance carriers and businesses.
